These Terms of Use govern your use of DraftHQ, the website at https://drafthq.live, and the related services operated by DraftHQ (collectively, the "Service"). Please read them carefully.
1. Acceptance of these Terms
By creating an account, joining a league, opening a display link, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
If you use the Service on behalf of a league or group, you represent that you are authorized to accept these Terms for yourself; each member of a league accepts these Terms individually when they use the Service.
2. What DraftHQ is
DraftHQ is a fantasy football draft preparation, simulation, scheduling, live-draft and post-draft recap product. It provides tools for:
- draft preparation and personal strategy organization (the War Room);
- mock drafting against computer-controlled opponents;
- scheduling a league's draft night and collecting member availability;
- running a live draft, including draft order, timers, keepers and picks;
- presenting a draft board on a shared screen such as a TV or projector;
- recaps, awards, draft history and a league record book.
DraftHQ is not an in-season fantasy league manager. It does not track weekly rosters, lineups, waivers, trades or scoring after the draft. DraftHQ does not operate fantasy contests, does not facilitate wagering, and does not offer betting advice.
3. Eligibility and accounts
You must be at least 13 years old to create an account. By using the Service you represent that you meet this requirement.
You are responsible for the accuracy of the information you provide, for keeping your sign-in credentials confidential, and for all activity that occurs under your account. Notify us promptly through Support if you believe your account has been accessed without your permission.
You may sign in with an email address and password or through a supported third-party sign-in provider such as Google. Your use of a third-party sign-in provider is also subject to that provider's terms.
4. Permitted use
You may use the Service for personal, non-commercial fantasy football drafting with your league, in accordance with these Terms and applicable law. Displaying the Live Board to the people in the room at your draft is expressly permitted.
5. Prohibited use
You agree not to:
- access another person's account, private War Room, league, mock history or draft controls without authorization, or attempt to bypass access controls;
- scrape, harvest, bulk-download or systematically extract data from the Service, or use automated means to make picks or interact with a draft;
- interfere with the operation of the Service, including by overloading, probing or disrupting its infrastructure;
- upload content that is unlawful, infringing, defamatory, hateful, sexually explicit, or that you do not have the right to use;
- impersonate any person or misrepresent your affiliation with a league, team or organization;
- reverse engineer, decompile or attempt to derive the source code of the Service except where the law permits it notwithstanding this restriction;
- resell, sublicense or offer the Service to third parties as your own product;
- use the Service for wagering, paid contests, or any activity that is unlawful where you are located.
6. Leagues, roles and league content
A league is created and administered by its primary commissioner, who may add co-commissioners and invite members. Commissioners can configure drafts, manage teams and members, and delete leagues or drafts. When a commissioner deletes a league, the league's drafts, picks, scheduling records, memberships, invitations and league-scoped War Rooms are permanently removed; see the Privacy Policy for details on what is retained.
Members are responsible for the league names, team names, notes and other content they enter. DraftHQ does not review league content in advance and is not responsible for it, but may remove content that violates these Terms.
Invitation links are intended for the person they are sent to. Do not publish invitation or display links where people outside your league can find them.
7. Your content
"Your Content" means the league names, team names, team logos and other images, notes, rankings, tiers, strategy marks and other material you submit to the Service. You keep ownership of Your Content.
You grant DraftHQ a non-exclusive, worldwide, royalty-free license to store, process, reproduce, display and transmit Your Content solely as needed to operate, secure and improve the Service — for example, to show a team logo on your league's Live Board, or to display a league's draft history to its members. This license ends when Your Content is deleted from the Service, except for copies in routine backups for a limited period.
You represent that you have the rights needed to upload Your Content and to grant this license, and that Your Content does not infringe anyone else's rights. Do not upload logos, photographs or artwork you do not have permission to use.
8. War Room and private strategy
Your War Room — including personal rankings, tiers, notes, queue, Target / Watch / Avoid marks and manual injury-concern flags — is private to your account. Other league members and commissioners cannot view it through the Service. War Room content is advisory only: it never makes a pick for you and does not change how a live draft validates picks.
9. Fantasy football information and disclaimers
Player information, positions, NFL team assignments, injury designations, rankings, average draft position (ADP) and other draft-market data, Availability Intelligence, mock draft results, awards, recaps and similar material in the Service are informational tools intended to help you prepare for a draft. They are not advice and are not guarantees of anything.
DraftHQ does not guarantee any player's performance, health or availability, the outcome of any draft, any fantasy result, or the accuracy, completeness or continued availability of third-party data.
Availability Intelligence is a summary of your own comparable mock draft history — how often a player was still available at your next pick in mocks with a similar setup. It is a historical observation, not a prediction or a guarantee, and it is always shown with the number of mocks it is drawn from.
Injury designations are surfaced for awareness only; DraftHQ never prevents you from drafting, keeping or queuing a player because of one.
10. Third-party services and data
The Service relies on third-party infrastructure and fantasy or sports data sources, which today include public NFL player data from Sleeper and average-draft-position data from Fantasy Football Calculator, and may in the future include other approved data providers and fantasy platforms. Third-party data remains subject to each provider's availability, terms and rights; DraftHQ does not control third-party services, and such data may change, become unavailable or contain inaccuracies.
If DraftHQ offers a connection to a supported third-party fantasy service in the future, connecting is optional, subject to that provider's terms, and used only to inform league setup. DraftHQ remains the system of record for your league and draft. No such connection is required to use the Service, and describing a provider in these Terms does not mean an integration with it is currently available.
Player names, team names, logos and other third-party marks belong to their respective owners. DraftHQ claims no ownership of third-party data or marks and is not affiliated with or endorsed by the NFL, any NFL team, or any fantasy platform unless expressly stated.
11. Intellectual property
The Service — including its software, design, draft presentation, text, graphics, the DraftHQ name and logo — is owned by DraftHQ or its licensors and is protected by intellectual property laws. Except for the limited right to use the Service under these Terms, no rights are granted to you. You may not use the DraftHQ name or logo without written permission.
If you send us feedback or suggestions, you agree we may use them without obligation to you.
12. Service availability, changes and discontinuation
We work to keep the Service available, especially on draft night, but we do not promise uninterrupted or error-free operation. Maintenance, outages, third-party failures and events outside our control can interrupt the Service. Live drafts are designed to re-synchronize with authoritative server state after a disruption, but you are responsible for how your league handles picks made during an outage.
We may add, change, suspend or discontinue any feature, or the Service as a whole, at any time. Where practical we will give reasonable notice of material discontinuation so you can export or record what you need.
13. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, DRAFTHQ DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE OR ANY DATA IN IT WILL BE ACCURATE, RELIABLE, SECURE OR UNINTERRUPTED. Some jurisdictions do not allow certain warranty disclaimers, so some of the above may not apply to you.
14. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, DRAFTHQ AND ITS OWNERS, OPERATORS, CONTRIBUTORS AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, LEAGUE HISTORY, FANTASY RESULTS, GOODWILL OR PROFITS, ARISING OUT OF OR RELATED TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF DRAFTHQ FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS (US$100). Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
15. Indemnification
You agree to defend, indemnify and hold harmless DraftHQ and its owners, operators and contributors from claims, damages, losses and reasonable expenses (including reasonable attorneys' fees) arising out of Your Content, your use of the Service, or your violation of these Terms or of anyone else's rights.
16. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate your access, remove content, or restrict features if we reasonably believe you have violated these Terms, created risk or legal exposure for us or other users, or if we discontinue the Service. Where reasonable we will tell you why.
Sections that by their nature should survive termination — including Your Content license for content that remains in a league's history, disclaimers, limitation of liability, indemnification and governing law — survive.
17. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page shows when they last changed. For material changes we will take reasonable steps to notify you, such as a notice in the Service. Continuing to use the Service after a change takes effect means you accept the updated Terms.
18. Governing law and disputes
These Terms are governed by the laws of the jurisdiction in which DraftHQ is established, without regard to conflict-of-law rules, unless applicable law requires otherwise.
Governing jurisdiction has not yet been designated by the product owner. This section will be updated when it is.
19. General
These Terms and the Privacy Policy are the entire agreement between you and DraftHQ about the Service. If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of the Service.
20. Contact
Questions about these Terms can be sent through the Support page at https://drafthq.live/support.
